BuildThese Terms of Service (“Terms”) govern your access to and use of the BuildAria construction management platform (the “Service”). By creating an account or using BuildAria you agree to these Terms. If you are accepting these Terms on behalf of a company or other organisation, you represent that you have authority to bind that organisation.
1. The service
BuildAria is a software-as-a-service platform that lets Australian builders and subcontractors manage estimates, variations, purchase orders, invoicing, contacts, checklists, scheduling and related project data. Features may evolve over time. We may add, change or discontinue features on reasonable notice.
2. Your account
- You must provide accurate account information and keep it up to date.
- You are responsible for keeping your credentials confidential and for every action taken from your account.
- You must promptly tell us if you suspect any unauthorised access.
- You must be 16 or older to use BuildAria.
3. Free trial & paid subscriptions
We may offer a free trial period during which no payment is required. When your trial ends, or if you subscribe to a paid plan directly, subscription fees are payable in advance for the applicable billing cycle (monthly or annual). Fees are exclusive of GST unless stated otherwise. You can cancel a paid subscription at any time; the cancellation takes effect at the end of the current billing cycle, and access continues until then. We do not refund partial periods, except where required by Australian Consumer Law.
4. Your content
You retain all rights, title and interest in the content you upload to BuildAria (estimates, contacts, photos, project data, documents, etc.). You grant BuildAria a limited, non-exclusive licence to host, process and display your content solely to provide the Service to you and the people you authorise. We will not use your content to market to third parties.
5. Acceptable use
You agree not to:
- Use the Service to break any law or infringe anyone else's rights.
- Upload malware, run automated scraping against the Service, or attempt to reverse-engineer it.
- Share your account with users outside your organisation without a matching user seat.
- Use the Service to send unsolicited bulk email (spam) or misleading commercial communications.
We may suspend or terminate accounts that breach these rules.
6. Third-party integrations
BuildAria integrates with third-party services (e.g., Google Gmail, Stripe, cloud hosting). Your use of those services is subject to their own terms and privacy policies. When you connect a Google account we act within the Google API Services User Data Policy — see our Privacy Policy for details.
7. Availability & support
We aim for high availability but do not guarantee the Service will be uninterrupted or error-free. We provide support via email at support@buildaria.com.au during Australian business hours. We may perform scheduled maintenance from time to time and will endeavour to give notice for anything user-visible.
8. Confidentiality & data security
Both parties will treat non-public information about the other as confidential. BuildAria uses industry-standard technical and organisational safeguards described in our Privacy Policy. In the event of a data breach that affects you, we will notify you and, where required, the Office of the Australian Information Commissioner under the Notifiable Data Breaches scheme.
9. Intellectual property
The Service, including all software, design, trademarks and content owned by us, remains the property of BuildAria and its licensors. Nothing in these Terms transfers any of that intellectual property to you.
10. Warranties & consumer guarantees
To the maximum extent permitted by law, BuildAria is provided “as is” without any warranties other than those that cannot lawfully be excluded, including certain guarantees under the Australian Consumer Law. Where such consumer guarantees apply and cannot be excluded, our liability is limited to re-supplying the Service or refunding the fees paid, at our option.
11. Limitation of liability
To the maximum extent permitted by law, BuildAria will not be liable for indirect, special, consequential or incidental damages, including loss of profits, revenue, business opportunity, or data. Our total liability arising out of or in connection with these Terms will not exceed the fees you paid us in the 12 months immediately before the event giving rise to the claim.
12. Termination
You can terminate your account at any time via the app settings or by writing to us. We may terminate or suspend your access if you breach these Terms or fail to pay fees. On termination we will retain your data for a reasonable period so you can export it, then delete it in line with our Privacy Policy.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified in-app or by email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance of the updated Terms.
14. Governing law
These Terms are governed by the laws of the State of New South Wales, Australia, and the parties submit to the exclusive jurisdiction of the courts of NSW.
